These terms are effective 1 October 2016
This policy is effective 1 October 2016. As a condition of your use of Sheralot.com, you agree that you will not:
• violate any applicable laws
• post any threatening, abusive, defamatory, pornographic, obscene, unconstitutional or indecent material;
• violate any applicable posting rules;
• post any material that is harmful to, harms or could harm others including minors in any way;
• infringe any third-party right;
• post for any other purpose but to share what is legally acceptable and by law rightfully yours
• distribute viruses or any other technologies that may harm Sheralot.com or the interests or property of Sheralot.com users;
• distribute or contain spam, chain letters, or pyramid schemes;
• impose an unreasonable load of data on the Sheralot.com infrastructure or interfere with the proper working of Sheralot.com;
• use any form of robots or other automated means to access Sheralot.com and collect content for any purpose without our express written permission;
• harvest or otherwise collect information about others, including email addresses, without their consent or otherwise violate the privacy of another person;
• copy, modify, or distribute any other person's content without their consent;
• bypass measures used to prevent or restrict access to Sheralot.com.
You are solely responsible for all information that you submit to Sheralot.com, any means of engagement with Sheralot.com and any consequences that may result from your post and or engagements. This Site reserves the right at our discretion to refuse or delete or take-down content deemed to be inappropriate or breaching the above terms. This Site also reserves the right, at our discretion, to restrict a user's usage of the site either temporarily or permanently, or to refuse a user's registration.
Sheralot.com reserves the right, at our discretion, to issue warnings, limit or terminate its service, remove hosted content or take technical and legal steps to keep users off Sheralot.com, if we believe that they are creating problems or acting in conflict with our policies. However, Sheralot.com does not accept any liability for monitoring Sheralot.com for unauthorized or unlawful content or use of Sheralot.com by users. Sheralot.com merely connects users with a common interest and is not involved in any transactions. Users of Sheralot.com automatically recognise and accept that Sheralot.com is not under any obligation to monitor any data or content which is submitted to or available on the site.
Using Sheralot.com is mostly free, but the Site charges a fee for certain optional services, like the promotion of adverts. Any services that incur a fee will be clearly marked for the user’s attention and the user will be able to review and accept the options and terms at the time of posting the advert. The Site’s fees are stipulated in South African Rand. Sheralot.com reserves the right to change its fees from time to time, temporarily or permanently. Sheralot.com will notify its users of any fee changes by publishing them on the site.
The Site’s fees are non-refundable, and you are responsible for paying them when they're due. If you don't, we may limit your ability to use the Services. If your payment method fails or your account is past due, we may collect fees owed using other permissible collection mechanisms.
Sheralot.com contains content from us, you, and other users that may be subject to copyrights laws. By accessing the services of the Site, you automatically agree not to copy, distribute or modify, reproduce, sell, re-sell or exploit content or any other aspect of Sheralot.com without our express written consent. Sharing of posted ads via social media buttons forms an exception and is explicitly marked for the user’s attention. You may not disassemble or decompile, reverse engineer or otherwise attempt to discover any source code contained in Sheralot.com.
When providing the Sheralot.com with content or causing content to be posted using our Services, you grant us a non-cancellable, non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable, transferable licence to exercise any and all copyright, publicity, trademark, and database rights and other intellectual property rights you have in the content, in any media known now or developed in the future. This means that we are entitled to host, cache, route, transmit, store, copy, modify, reproduce, distribute, syndicate, publish, translate, use, publicly perform, publicly display, reformat, modify, edit, excerpt, analyse, and create algorithms and derivative works from your content, or otherwise use such content.
Further, when accessing our Services, you will be exposed to content from a variety of sources. Sheralot.com is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such content, and you agree and assume all liability for your use. You further may be exposed to content that is inaccurate, offensive, indecent, objectionable, defamatory or libellous.
By using the Site, you agree to waive any moral, legal or equitable rights or remedies you have or may have against Sheralot.com with respect to the above.
This site makes use of icons and images that are licensed as free for commercial use. All icons can be found on: http://www.geekchamp.com/icon-explorer/introduction. Images can be found on www.pixabay.com, www.freeimages.com, www.unsplash.com and www.stockfreeimages.com.
Infringement and Take-Down Notification
Do not post content that infringes the rights of third parties, including but not limited to intellectual property rights such as copyright and trademark (e.g. offering counterfeit items for sharing, rental, or sale). If you are an owner of intellectual property rights or an agent who is fully authorised to act on behalf of the owner of intellectual property rights and believe that any content or other content infringes upon your intellectual property right or intellectual property right of the owner on whose behalf you are authorised to act, you may submit a notification to Sheralot.com together with a request to remove and delete the relevant content in good faith. The notification and the request must conform the following guidelines as stipulated in the Electronic Communications and Transactions Act:
77. (1) For the purposes of this Chapter, a notification of unlawful activity must be in writing, must be addressed by the complainant to the service provider or its designated agent and must include —
(a) the full names and address of the complainant;
(b) the written or electronic signature of the complainant;
(c) identification of the right that has allegedly been infringed;
(d) identification of the material or activity that is claimed to be the subject of unlawful activity (by means of a weblink);
(e) the remedial action required to be taken by the service provider in respect of the complaint;
(f) telephonic and electronic contact details, if any, of the complainant; (g) a statement that the complainant is acting in good faith;
(h) a statement by the complainant that the information in the take-down notification is to his or her knowledge true and correct; and
(2) Any person who lodges a notification of unlawful activity with a service provider knowing that it materially misrepresents the facts is liable for damages for wrongful takedown.
(3) A service provider is not liable for wrongful take-down in response to a notification.
You agree not to hold us responsible or liable for things other users post or do. We do not review users' postings and are not involved in the actual transactions between users. As most of the content on Sheralot.com comes from other users, we do not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what's offered or the use thereof.
In no event does Sheralot.com accept any form of liability for the posting of any unlawful, threatening, abusive, defamatory, obscene or indecent information, or material of any kind which violates or infringes upon the rights of any other person, including any postings and transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any applicable law.
Sheralot.com may promote, endorse and/or contain links to third party sites and/or services and/or goods. These sites, services and and/or goods are beyond the control of Sheralot.com. Sheralot.com is not involved in transactions between users and the operators of such third-party sites. Sheralot.com does not accept responsibility for their content, services and/or products.
We cannot guarantee continuous, error-free or secure access to the Services or that defects in the Service will be corrected.
While we will use reasonable efforts to maintain an uninterrupted service, we cannot guarantee this and we do not give any promises or warranties (whether express or implied) about the availability of our services.
To the legally permitted extent, we explicitly disclaim all liabilities, warranties, representations and conditions, direct or indirect, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of Sheralot.com, even if you advise us or we could reasonably foresee the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.
Notwithstanding the previous paragraph, if Sheralot.com is found to be liable, our liability to you or any third party (whether in contract, delict, negligence, strict liability in delict, by statute or otherwise) is limited to the greater of (a) the total fees you paid to Sheralot.com in the past 12 months prior to the action giving rise to liability, and (b) 100 South African Rand.
Security & Cyber Crime
In order to ensure the security and reliable operation of the Site for all users, Sheralot.com reserves the right at its discretion to take whatever action it finds necessary to preserve the security, integrity and reliability of its network and back-office applications. Any user who commits any of the offences detailed in the Electronic Communications and Transactions Act, 2002 (specifically sections 85 to 88 (inclusive)) shall, notwithstanding criminal prosecution, be liable for all resulting liability, loss or damages suffered and/or incurred by Sheralot.com and its affiliates, agents and/or partners.
Resolution of disputes
If a dispute arises between you and Sheralot.com, we strongly encourage you to first consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.
